AM Design End User License Agreement

for AM Design Photoshop plugins

This agreement is between you and Cale Butler, trading as AM Design ("AM Design", "we", "us"). It covers the AM Design Photoshop plugins you buy or receive from us. Please read it. By installing, activating or using a plugin, you agree to it. If you do not agree, do not install or use the plugin, and contact us within the refund period for a refund.

1. WHAT THIS AGREEMENT COVERS

This agreement covers these Photoshop plugins, and any update to them we provide:

  • MoshMachine
  • RetroMachine
  • PrintMachine
  • BitMachine
  • Airbrusher
  • SmartLink

It covers the plugin files, any documentation that comes with them, and any license key or license file we issue for them. Together these are "the Software".

2. LICENSED, NOT SOLD

The Software is licensed to you, not sold. We, and our licensors, keep all ownership, copyright and other rights in it. You get only the rights this agreement gives you.

3. WHAT ONE LICENSE KEY GIVES YOU

When you buy a plugin, you receive a license key by email. One key may cover more than one plugin if you bought more than one.

Your key lets you install and use the plugins it covers, for as long as this agreement lasts, on up to two (2) computers at a time. Each computer you activate on uses one of the two. Two plugins on the same computer use only one.

The same page lists the computers your key is active on, and can email you a lost key.

The key is for you alone, or for one person in your business. It is not a site license and may not be used by a team.

4. ACTIVATION, RENEWAL AND OFFLINE USE

Each plugin must be activated online, once on each computer, by entering your license key in the plugin's panel.

After that, the plugin renews its license with our license server when you open its panel, at most about once a day. A renewal you do not see is normal.

You can work offline. A license stays valid for 14 days after its last renewal. After that, the plugin warns you and keeps working for 7 more days. After those 7 days, the plugin locks until you connect to the internet and open its panel again.

You will need to enter your key again after you uninstall and reinstall a plugin, and after a major Photoshop upgrade. Your computer keeps its place among your two, so this does not use up a second computer. A change to your computer's hardware or user account may be counted as a new computer; free the old one on the page above if that happens.

We may change how activation and renewal work in an update.

5. WHAT YOU MAY NOT DO

You may not, and may not let anyone else:

  1. share your license key, or give, sell, rent, lend or transfer it;
  2. copy, share, resell, sublicense or redistribute the Software, in whole or in part, except to install it as this agreement allows;
  3. modify the Software, or make works based on it;
  4. reverse engineer, decompile or disassemble the Software, except where the law allows it despite this limit;
  5. remove, disable, get round or interfere with the license check, the license key or the license file, or use a key or license file not issued to you;
  6. remove or change any copyright or license notice in the Software.

6. WHAT YOU MAKE WITH IT

Images and other work you create with the Software are yours. You may use them for any purpose, personal or commercial, including client work, prints and merchandise, without credit to us. This does not let you sell or share the Software itself, its presets as a product of their own, or anything that lets someone else use the Software without a license.

7. REFUNDS END THE LICENSE

If a plugin's purchase is refunded or the order is cancelled, your license for that plugin ends, and its key no longer activates or renews it. If your key covered other plugins, it keeps covering those. A partial refund of the price, such as a later discount, that does not refund the plugin itself does not end the license.

A plugin whose license has ended may keep running until its current license runs out, up to 21 days. You must stop using it and uninstall it when the license ends.

If you are a consumer in the European Union or the United Kingdom, your right to withdraw from the purchase within 14 days ends once the download begins, if you agreed to that at checkout.

8. WHAT THE PLUGINS SEND, AND WHY

A plugin that needs a license connects only to our license server, api.amdesigntools.com. When it activates or renews, it sends:

  • your license key;
  • a device id, a random number the plugin makes once and saves on your computer;
  • a one-way hash of six values about your computer: its operating system, processor architecture, home folder path, total memory, processor model and processor count. The values themselves are never sent or saved; only the hash is;
  • a label naming the plugin and the platform, such as "MoshMachine on Windows";
  • which plugin is asking.

We use these to count your computers against your two, to keep a computer's place when you reinstall or upgrade, to show your computers on the manage page, and to renew your license. We record when each computer was last seen. The plugins do not send your images, your documents or anything you make.

9. UPDATES

We may provide updates. Updates are covered by this agreement, or by the version of it that comes with the update. We do not promise any update, feature or support for any length of time, or that a plugin will keep working with future versions of Photoshop.

10. ENDING THIS AGREEMENT

This agreement lasts until it ends. It ends:

  • when your license ends under section 7;
  • automatically, if you break it. We may also stop your key from activating or renewing if you break it;
  • if you uninstall the Software and delete every copy.

When it ends, you must stop using the Software and uninstall it. Sections 2, 5, 6, 11, 12 and 13 still apply after it ends.

11. NO WARRANTY

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SOFTWARE OR THE LICENSE SERVER WILL BE UNINTERRUPTED OR ERROR FREE. SAVE YOUR WORK AND KEEP BACKUPS.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST DATA, WORK, PROFITS OR BUSINESS, ARISING FROM THE SOFTWARE OR THIS AGREEMENT. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE PLUGIN THE CLAIM IS ABOUT.

Some places do not allow some of these limits. Where they do not, they apply only as far as the law allows. Nothing in this agreement takes away rights you have by law as a consumer that cannot be waived.

13. GENERAL

This agreement is governed by the laws of the State of Florida, USA, without regard to its conflict of law rules. Disputes go to the state courts in Brevard County, Florida, or the federal courts for the Middle District of Florida, unless the law of your country gives you the right to bring them where you live.

This agreement is the whole agreement between us about the Software. If a part of it cannot be enforced, the rest still applies. If we do not enforce a part of it, we have not given it up. We may publish a new version of this agreement; it applies to updates that come with it.

Parts of the Software are third-party code under their own licenses, which this agreement does not limit.
